Crime

Andrew Bousfield qualified as a barrister in 2004 and came to 3PB in 2015, having worked for ten years both as an investigative journalist (Private Eye and the Centre for Investigative Journalism) and as a newspaper lawyer on the editorial floor for several national newspapers (The Mirror and The Independent).

At 3PB, Andrew's practice is in both employment law (largely claimant whistleblowing cases) and in crime.

Andrew is a trial advocate with experience of multi-day trials in whistleblowing and discrimination. Andrew has acted in over 30 whistleblowing cases. Andrew works with Whistleblowers UK to ensure access to justice for many whistleblowers. In his criminal practice, Andrew largely prosecutes but also takes on defence briefs.

Andrew enjoys complicated cases which require considerable investigation of the evidence. Using his background as an investigative journalist, Andrew has the ability to listen and get to the bottom of complicated set of facts.

As a journalist, Andrew investigated the NHS, money laundering, the MOD and several other matters.  He won the Paul Foot Award in 2015 for a six-page investigation into a whistleblowing case exposing alleged bribery and corruption through a UK military contract in Saudi Arabia, which involved tracking millions of pounds of illicit payments through various offshore centres.  It is currently the subject of an ongoing SFO investigation.  He also was runner up in 2012 for the Martha Gellhorn International Investigative Journalism Award, with Dr Phil Hammond, for an eight-page investigation into the treatment of whistleblowers in the NHS which led to the partial banning of ‘gagging’ clauses.

Andrew is direct access qualified, and is able to assist from early stages in getting cases ready to win at trial and give early sensible advice.  Andrew works with other barristers within Chambers, especially with a criminal background, as part of a team to advance sensitive whistleblowing cases.

Andrew is trained in forensic accounting and enjoys cases which involve a high level of forensic detail in order to prove whistleblowing allegations.

Dr Frost v. MOD
Led by John Hendy QC in multi day whistleblowing trial.  Judgment awaited.

Dr Hayley Dare v. Broadmoor (West London Mental Health Trust)  2014
Andrew represented Dr Dare, the Clinical Director for Women’s Forensic Services, in a one week trial for whistleblowing detriments.  The case is subject to an ongoing EAT appeal.  Andrew undertook the trial pro bono on a non-practising basis.

NHS Surgeon
Ongoing case settled against an NHS Trust with failing compliance rates for cancer care.  Whistleblowing detriments and constructive unfair dismissal.
